Our Warranty Commitment

This warranty does not cover costs of installation, removal, or reinstallation of the natural characteristics of wood to have raised grain, split, warp, shrink, swell, or twist, or damage caused by physical abuse, acts of God, acts of war, or other chemical or biological factors. Warrantor's sole obligation in Warrantor's sole discretion is limited to replacement of the product or a monetary refund up to the original purchase price of the wood, and warrantor shall have no further liability or obligation except as expressly stated herein. Warrantor shall not be liable for any indirect, incidental, punitive, consequential, exemplary, or other damages of any kind whatsoever, whether any such claim is based upon theories of contract, warranty, negligence, tort, strict liability or otherwise.

The Warranty does not apply to any of the following uses: foundation piles, poles, supports in pole-frame structures, swimming pool sidewalls, tree, vine, or plant supports, use in commercial or industrial projects or any applications involving immersion of the product in water or any specialty items that have been milled after treatment. Discoloration from stains, such as metallic rust and other corrosive compounds are excluded from coverage under this warranty. This warranty specifically excludes any color variations due to changes in color and/or appearance on any and all walking surfaces, seating surfaces, climbing surfaces, or other wearing surfaces. This shall include, but not be limited to, color variations or wear due to repeated foot and hand traffic. This warranty does not cover corrosion of fasteners, hardware, or any other material(s) or any damage resulting from such an occurrence and it excludes any mold growth on branded wood. Always follow the guidelines stated in the applicable Safe Handling Information Sheet/Section when working with or handling this product. Warrantor and its representative(s) reserve the right to investigate any claim and to inspect the materials on which a claim is made prior to its removal from services.

The term "Significant Color Changes" as used in this warranty shall mean significant changes in the original color of the product that are not due to fading or other changes due to the natural characteristics of the wood itself. Significant color changes does not mean natural color variations due to exposure to sunlight, saltwater, and other weather conditions. Color variation within our acceptable range and change in color due to exposure to sunlight, saltwater and other weather conditions shall not be deemed significant color changes and such product is not covered by this warranty. Natural color variations are to be expected as they evidence the character of a natural wood product. Such natural variations reveal the color variation between different species of wood and the individual characteristics of the board or rail similar to the way heartwood, knots, or sapwood will impact the product color. Significant color changes shall not mean attack by wood-destroying fungi that disintegrate the wood cell walls. Color changes associated with surface mold, and mildew are not included in the definition of significant color changes and are not covered under this warranty. Other changes in appearance caused by the natural weathering of wood, including but not limited to, raised grain, splitting, checking, twisting, warping, shrinkage, swelling or any other physical property of wood, are not covered under this warranty.

The Fence Lady & Co. Corporation warrants to the original end user and not to any other purchaser or subsequent owner, that its Ornamental Iron Fence System is free from defects in material and workmanship and, under normal or proper usage, will not corrode, crack, peel, chip or blister for a period of ten (10) years from the date of original purchase. This warranty does not apply in marine/salty/coastal/wet or harsh industrial environments. This warranty only applies to defects resulting from normal use; any of the following events or conditions will void this warranty: faulty installation, damage during transportation, alteration of the product of any kind (including but not limited to affixing any other materials to the product); accident, abuse, fire, flood, damage caused by landscaping, landscaping equipment, harsh or abrasive chemicals, or exposure to salt or any other substance that has or includes a high mineral content, plant growth, or acts of God. The Fence Lady & Co. Corporation reserves the right to inspect the material to determine validity of any claim under this warranty.

UNDER THIS WARRANTY, THE FENCE LADY & CO. CORPORATION, OBLIGATION IS LIMITED TO THE REPAIR OR REPLACEMENT (AT MANUFACTURER'S OPTION) OF DEFECTIVE MATERIAL ONLY ON A PRORATED BASIS. Reimbursements for the cost of removal and/or installation are not included, and The Fence Lady & Co. Corporation will not provide such service. If any material appears to have a defect in material or workmanship, the original customer must advise the contractor from whom the material was purchased, in writing with a copy to The Fence Lady & Co. Corporation at the address provided (1044 Brocade Dr. Highlands Ranch, CO 80126). Return of the warranty form is not a condition to warranty coverage, provided you can adequately prove that the materials installed were purchased from The Fence Lady & Co. Corporation.

THE FENCE LADY & CO. CORPORATION IS NOT RESPONSIBLE FOR INJURY, PROPERTY DAMAGE, OR OTHER INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING DIRECTLY OUT OF THE USE OF THIS MATERIAL, NOTWITHSTANDING THE FACT THAT SAID INJURY, PROPERTY DAMAGE OR OTHER DAMAGES AROSE DIRECTLY OR INDIRECTLY FROM AN ACTUAL OR ALLEGED DEFECT IN MATERIAL AND/OR WORKMANSHIP. SOME JURISDICTIONS DO NOT ALLOW AN EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY IN ALL REGIONS.

The Fence Lady & Co. stands behind its craftsmanship and installation with a one-year installation warranty. A Fence Lady & Co. installed motor is warranted against installation defects or failures for one year. This warranty does not provide protection against any failure, defect, or damage caused by situation(s) or event(s) beyond normal/reasonable exposure conditions, including, but not limited to, misuse, abuse, or neglect, material failure, or other failure covered in the manufacturer's warranty, use of accessories which do not properly receive and/or secure to the material, impact of foreign objects, fire, earthquake, flood, lightning, hail, hurricane, tornado, snow, or any other casualty or act of God, damage caused by horses, or any large animal, damage caused by direct contact with any form of water or moisture (including, but not limited to, sprinklers, irrigation, drainage, sewage, swimming pools, or excessive dew or fog due to proximity to a large body of water or open land), damage caused by other circumstances and causes beyond The Fence Lady & Co. control, or movement, distortion, collapse, or settling of the ground/structure on which the fencing is installed. All material and components are covered under the manufacturer warranty only.
